Second train manufacturer launches legal action over HS2’s rolling stock procurement

HS2 Ltd is facing legal action from a second train manufacturer in relation to its rolling stock procurement process.

Siemens Mobility started legal proceedings last week, filing a Part 7 procurement claim against HS2 Ltd on June 21.

Neither HS2 Ltd nor Siemens would confirm any more details about the claim.

Siemens is one of five shortlisted bidders for the high speed train contract. Other shortlisted bidders include Alstom, CAF, Talgo and a joint venture between Bombardier and Hitachi, with a winner due to be announced in the summer.

The legal challenge comes shortly after HS2 Ltd agreed an out of court settlement with Talgo in relation to the same procurement process.

Talgo’s challenge came after HS2 Ltd informed the company it would not continue to stage five of the procurement process in January. Following this, in March and April, Talgo issued proceedings against HS2 Ltd.

Talgo’s challenged centred on three preliminary issues. The first was the allegation that HS2 Ltd unlawfully permitted some tenders to proceed with changes having been made to the tenders and/or qualifications made to the bids.

The second claim was that HS2 Ltd acted in breach of its obligations in relation to the acquisition by Alstom of Bombardier during the procurement process (both were tenderers).

Finally, Talgo claimed the procurement has been impaired by apparent bias.

These claims were all disputed by HS2 Ltd.
